US lower court judges are challenging Trump’s ‘war on the rule of law’, experts say

…Ty Cobb, a former federal prosecutor who was special White House counsel for a year in the first Trump administration, sees widespread legal repercussions from the administration’s battles against judges. 

“For the first time since 1826, the government no longer gets the benefit of the doubt about the honesty of their representations,” before the lower courts, Cobb said. “The longstanding ‘presumption of regularity’ has been forfeited because of the overwhelming number of lies which have increasingly infected administration claims.” 

Looking ahead, Cobb noted: “Trump’s continuing attacks on the judiciary, over the clearly stated objection of the chief justice, is just fascism at work. He is purposely denigrating the branch of government that must apply the Constitution to his corruption and overreach in order to accumulate more power for himself.”…

The umpire who picked a side: John Roberts and the death of rule of law in America

Prominent jurists have held Roberts responsible for emboldening Trump's drive towards an authoritarian presidency. J Michael Luttig, who served on a federal appeals court for 15 years, put the criticism starkly. 

"The chief justice is presiding over the end of the rule of law in America," Luttig told the Guardian. 

In Luttig's view, the court under Roberts is "acquiescing in and accommodating the president's lawlessness. And it is doing so without briefing, without argument, without deliberation – and without even a single word of explanation of its decisions."… 

 "The supreme court was never intended to function like this. Never before has it entertained such challenges from the president, and never before has it decided them so flippantly."

Outrage after JD Vance claims judges are not allowed to check executive power | Trump administration | The Guardian

…In fact, article III of the US constitution confers a power known as judicial review, which gives federal judges the authority to rule on cases involving the president, as well as other branches of government. 

Vance's comments drew widespread criticism. 

Daniel Goldman, a Democratic representative from New York, responded on X: "It's called the 'rule of law'. Our constitution created three co-equal branches of government to provide checks and balances on each other ('separation of powers')….

Mock Trial: Should Trump’s Conviction Stand? (John Donvan; Open to Debate podcast)

Donald Trump is the first former president to be convicted of a crime. He was found guilty of 34 felony counts of falsifying business records in the first degree under New York law. Trump has the right to appeal and announced the day after the conviction that he would. 

Now there is also a Supreme Court ruling that says presidential immunity is permitted for official acts committed in office. Legal scholars are questioning whether his conviction could be overturned and what could come next. 

Those defending the New York court conviction argue that no individual, regardless of their office, is above the law, and keeping Trump accountable is crucial for upholding the rule of law. Its overturning would set a dangerous precedent undermining the judicial system’s integrity. 

Those arguing for the defendant argue the laws under which Trump was convicted were misinterpreted or misapplied, possibly extending beyond their intended scope and his actions, since they were during his tenure, and some may have been within remit of his official duties.

As such, it was hardly surprising that just as when Mr. Trump faced a chilly reaction from hundreds of top executives when he spoke at my Yale Chief Executive summit in 2005, he appeared to face a similarly frigid reception when he spoke to the Business Roundtable this month, with no noticeable applause at any point during his "remarkably meandering" remarks, according to CNBC's Andrew Ross Sorkin, and with Mr. Trump assuming a subdued, if not hostile, posture. Chief executives are not protectionist, isolationist or xenophobic, and they believe in investing where there is the rule of law, not the law of rulers...
