Lawyer Liz Oyer on Trump’s Corrupt Pardons (Al Franken podcast YouTube)

In Donald Trump's second term, we've seen a flurry of pardons and commutations. Of course, every President is granted the pardon power, but with this administration, pardons often seem to have a price tag. We're joined by Liz Oyer, former US pardon attorney (appointed by Biden and fired by Trump), to discuss some of the shadier pardons doled out during Trump's second term (so far).

Oyer lays out how several of Trump’s pardons are motivated by money, loyalty, and retribution. Of course, we discuss the blanket pardon of the January 6th rioters, but we also examine the pardon of cryptocurrency-crook Changpeng Zhao, who Oyer says "might be the most corrupt pardon in American history."

We dig into Trump's current pardon attorney, Ed Martin, a political operative who believes in "No MAGA left behind." Even Republicans found him too extreme to be a US Attorney, so Trump put him in charge of pardons and commutations.

Plus, we get Oyer's unfiltered opinion of the Ghislane Maxwell/Jeffrey Epstein saga AND Hunter Biden's pardon at the end of Joe Biden's term.

If the files suggest that Trump's involvement with Epstein really was just of the harmless social variety prior to their reported falling out in 2004, then the Biden administration would have had no obvious political reason to release them. (Former President Bill Clinton's name appears in the files that were already released, although there is no allegation of any wrongdoing on Clinton's part.) 

But it also couldn't have done so without court approval. Grand jury testimony is secret by design: It allows jurors to confer about whether to charge someone with a crime confidentially and without outside influence or fear of public backlash. Such testimony is typically only released under exceptional circumstances, when a judge determines that the public interest overrides the interest in protecting the identity of witnesses, informants, and other people accused of crimes brought before the grand jury…

In sporadic public appearances since leaving the White House, Biden has hit back against new reporting that alleges a "cover up" by the then-president's closest aides to hide his frailty and decline from an American public who polls showed believed he was too old to serve another four years… 

The White House and congressional Republicans have amplified the claims, opening investigations into whether Biden was in control when he made a series of notable clemency decisions at the end of his presidency. In this episode, Open to Debate’s moderator-in-chief John Donvan and chief content officer Lia Matthow sit down with the co-moderator of that historic debate, CNN anchor Jake Tapper and Axios’s Alex Thompson to discuss their book “Original Sin: President Biden's Decline, Its Cover-up, and His Disastrous Choice to Run Again.” 

As a debate organization, we wanted to know more about what transpired before, during, and after that night and what lessons can be learned for journalists, Democratic and Republican party leaders, and, of course, what can be gleaned about the importance of presidential debates in determining elections.
