Judges Keep Striking Down Climate Laws. Some States Are Fighting Back. – Mother Jones

Hollins, who introduced and co-sponsored Minnesota’s superfund bill earlier this year, told me that Minnesotans could face $20 billion or more in climate-related costs by 2040. “That’s roughly a third of our state’s current budget,” she said. Her state’s superfund legislation would charge major polluters for damages to bridges, roads, and buildings caused by greenhouse gas emissions. That money would pay for natural disaster recovery, infrastructure projects, and public health efforts linked to pollution. 

Infrastructures costs, Hollins notes, are inevitably going to rise. “So is it taxpayers who are going to pay for it?” she asks. “Or is it billionaires?”

The rightwing campaign to control how US judges view the climate crisis

As cities and states sue big oil for billions in damages over allegations that it covered up the dangers of its products, rightwing organizations are attempting to discredit the wave of litigation. They claim the lawyers behind it are teaming up with an environmentally focused legal education non-profit to bias federal judges against oil companies. 

But it is actually fossil fuel-backed organizations that are attempting to sway the judiciary in their favor, one of those law firms is countering. Evidence of this includes judicial seminars hosted by one such group featuring pro-industry speakers such as the current energy secretary, Chris Wright, in his former occupation as a fracking executive…

US lower court judges are challenging Trump’s ‘war on the rule of law’, experts say

…Ty Cobb, a former federal prosecutor who was special White House counsel for a year in the first Trump administration, sees widespread legal repercussions from the administration’s battles against judges. 

“For the first time since 1826, the government no longer gets the benefit of the doubt about the honesty of their representations,” before the lower courts, Cobb said. “The longstanding ‘presumption of regularity’ has been forfeited because of the overwhelming number of lies which have increasingly infected administration claims.” 

Looking ahead, Cobb noted: “Trump’s continuing attacks on the judiciary, over the clearly stated objection of the chief justice, is just fascism at work. He is purposely denigrating the branch of government that must apply the Constitution to his corruption and overreach in order to accumulate more power for himself.”…

Chief justice John Roberts calls for end to ‘dangerous’ hostility toward judges

"The problem sometimes is that the criticism can move from a focus on legal analysis to personalities, and you see … that it's more directed in a personal way," Roberts said. "And that, frankly, can be quite dangerous."

 He added: "Judges around the country work very hard to get it right. And if they don't, their opinions are subject to criticism. But personally directed hostility is dangerous and it's got to stop."…
