Hawaii vs. Citizens United

Earlier this month, a nearly unanimous and bipartisan majority…of Hawaii’s state legislature voted to change the powers of corporations doing business in the state and no longer grant them the ability to spend on most political causes. 

 “Corporations are not people. They are granted powers and privileges by the state,” State Senator Jarrett Keohokalole told me this week, explaining the rationale of the bill he sponsored. “How can a creation of the state have inalienable rights? It doesn’t make any sense.”…

However, in order for applications for permanent residency to be successful, companies must certify their inability to find a suitable American candidate to take the position they're looking to fill with a foreign national. Unsurprisingly, that means some companies have been incentivized to hide job openings from U.S. citizen and resident applicants...

As such, it was hardly surprising that just as when Mr. Trump faced a chilly reaction from hundreds of top executives when he spoke at my Yale Chief Executive summit in 2005, he appeared to face a similarly frigid reception when he spoke to the Business Roundtable this month, with no noticeable applause at any point during his "remarkably meandering" remarks, according to CNBC's Andrew Ross Sorkin, and with Mr. Trump assuming a subdued, if not hostile, posture. Chief executives are not protectionist, isolationist or xenophobic, and they believe in investing where there is the rule of law, not the law of rulers...

The controversial arbitration system which allows corporations to sue governments for compensation over decisions they argue affect their profits is largely carried out behind closed doors, with some judgments kept secret. Companies paid top executives more than they paid in US taxes – report | Business | The Guardian

Analysis by Americans for Tax Fairness (ATF) and the Institute for Policy Studies (IPS) found the collective net federal income tax bill of all 35 companies was negative $1.72bn over the five-year stretch – meaning they collectively received more money back from the government in refunds than they paid. 

 Over the same period, executive compensation for senior executives at these firms – including salaries, bonuses, perks, benefits, stock options and stock awards – stood at $9.49bn…
