Supreme Court widens Trump’s power to fire agency leaders — except the Fed - POLITICO

The justices didn’t detail how much evidence of wrongdoing would be needed to dismiss her, but zeroed in on the Justice Department’s claim that Trump had accorded her due process by issuing a Truth Social post demanding her resignation.

“The President’s post did not suggest that a response from Cook would be appropriate, nor did it even provide a clear account of the charge made against her. It instead read simply ‘Cook must resign, now!!!’ and linked to a news article,” Roberts wrote. “That will not do. At minimum, Cook was entitled to some explanation of the evidence at issue, some avenue for a response, and a deadline by which a response would be due.”…

Federal agencies blame Democrats for looming shutdown in apparent Hatch Act violation

"Yes, this violates the Hatch Act," said Kathleen Clark, professor of law at Washington University.

The email appeared to "impose on Democrats the blame for a government shutdown and resulting furloughs of agency employees", she said. "In other words, this email has a partisan political goal. This email is both a violation of the Hatch Act and an abuse of government power."…

US judge blocks Trump bid to ban DEI by federal agencies, contractors | Reuters

Abelson on Friday said the orders, and the definition of DEI, are so vague that it was not possible for the plaintiffs to determine how Trump's directives applied to their programs.

"Plaintiffs have adequately shown that their speech has been and will continue to be chilled in light of the challenged orders based both on actions currently being taken by Defendants and based on Plaintiffs' reasonable fears," wrote Abelson, an appointee of Democratic former President Joe Biden...

Adam Schiff says Trump 'broke the law' in firing inspectors general - POLITICO

"The American people, if we don't have good and independent inspector generals, are going to see the swamp refill," Schiff said. "They're going to see rampant waste fraud. They're going to see corruption. It may be the president's goal here, when he's got a meme coin that's making him billions is to remove anyone that's going to call the public attention to his malfeasance."

Trump’s plot would take ‘wrecking ball’ to US institutions, key Democrat warns

"It is just a wrecking ball against everything that most of us hold dear about our country and our democracy, and that's the biggest challenge we face … How do you explain that this really is what they're going to do without overwhelming people?"…

A press release for the taskforce noted: "While Project 2025 is being run out of the Heritage Foundation, its advisers include former Trump White House aides like Stephen Miller, and more than half the groups supporting the effort have received $21.5m in funding from Leonard Leo's dark-money network."…

At Chevron arguments at Supreme Court, Kagan’s questioning exposes the stakes

She summed up the issue as whether the countless policy issues confronting the nation will be decided by courts that don't have expertise or agencies that do...

For context, it's important to understand that the Chevron decision came in 1984, when Republicans had executive power and wanted to wield it instead of judges. Now that Republicans have reshaped the high court — cementing a 6-3 conservative majority — they want the justices to hold that power…

Vivek Ramaswamy wants to trigger mass layoffs at federal agencies — and he thinks the Supreme Court will back him up

On Monday, Christie called Ramaswamy's idea to eliminate the FBI "one of the stupidest ideas I've ever heard," citing anti-terrorism efforts the bureau has undertaken in the aftermath of the Sept. 11, 2001, terrorist attacks.

"Don't throw that out for a sound bite at a debate to make yourself sound like you're really smart and aggressive when you're really shallow and only 38 years old," Christie said at an event in New Hampshire.

‘America First 2.0’: Vivek Ramaswamy pitches to be Republicans’ next Trump

Like barroom bores across the country, he thinks the US has lost its "civic pride, civic identity, civic duty". He has said affirmative action – the effort designed to ensure colleges and businesses offer equal opportunities to people of color, and people of all genders and sexual orientation – is "a cancer on our national soul". His opposition to affirmative action, however, invariably lands on policies which may benefit Black or Latino Americans.

"Top companies now regularly disfavor qualified applicants who happen to be white or Asian," he tweeted in June. "Time to restore colorblind meritocracy once and for all."

Ramaswamy did not provide any evidence for his claim and did not respond to a question on the topic from the Guardian. Last year, a reportby the Economic Policy Institute (EPI) found that "one of the most durable and defining features of the US labor market is the 2-to-1 disparity in unemployment that exists between black and white workers"...

DeSantis says he would eliminate four federal agencies if elected president

"We would do Education, we would do Commerce, we'd do Energy, and we would do IRS," DeSantis said in an interview with Fox News' Martha MacCallum when he was asked whether he favored closing any agencies.

"If Congress will work with me on doing that, we'll be able to reduce the size and scope of government," he added. "If Congress won't go that far, I'm going to use those agencies to push back against woke ideology and against the leftism that we see creeping into all institutions of American life."…

The Supreme Court's next target is the executive branch

There are many ways for the conservative court to rein in federal agencies, and while there may not be a clear consensus on precisely which of those avenues to take at any given moment, one way or another, federal agencies exerting broad-based powers are already losing — and are almost certainly going to keep losing...

The Supreme Court Could Foster a New Kind of Civil War - POLITICO

This isn't just an obscure point of administrative law: A study last year found that 99 percent of major federal laws include delegation of rule-making to agencies, leading Amherst College political science professor Austin Sarat to warn recently that reducing those agencies' ability to interpret statutes is "a frontal assault on the federal government's ability to promote the health, safety and welfare of citizens."…
