As crypto and prediction markets expand, the CFTC shrinks : NPR

Since Trump took office, the CFTC has rolled back its enforcement actions against crypto firms Gemini, Celsius, and FTX. But crypto cases weren't the only ones impacted. Konizeski said decreased staffing caused the CFTC to dismiss others such as a foreign exchange fraud case against WorldWideMarkets Inc. The company was accused of defrauding millions from users…

Colin McDonald confirmed for new DOJ fraud enforcement role : NPR

"If the Justice Department wanted to increase fraud prosecutions, then they should be taking action to strengthen enforcement and not weakening it," Carbone, the former prosecutor, said. "The way that should be done is through the existing structure, instead of cutting resources to the fraud section."…

Democratic AGs sue HUD over anti-discrimination enforcement roll back - POLITICO

"HUD is attempting to impose vague, ideologically motivated and unlawful conditions on program funding," Illinois Attorney General Kwame Raoul said in a press conference Monday. "If these actions are left unchallenged, discrimination in housing is almost certain to increase."

The HUD guidance to state agencies reflects an administration-wide effort to pull back on anti-discrimination regulations that some Republicans and industry advocates consider overly zealous...

Enforcement of laws against polluters nearly non-existent in US, analysis finds

"Without an adequate enforcement program that provides deterrence to polluters, the laws become voluntary, and when laws become voluntary many companies choose to ignore them because they know there are no consequences," Whitehouse said. "That means more pollution for communities near the facilities and more profits or the polluters."…

Trump's EPA issues record low legal actions against polluters, watchdog group finds

By examining court records, the group found that only 16 legal actions were taken against alleged polluters on the EPA's behalf by the Department of Justice. That's 87% lower than Obama's first year of his second term and 76% lower than Biden's first year. And that's 81% lower than even the first year of Trump's first term in 2017.

Montana youth activists who won climate case petition for enforcement

In a groundbreaking legal decision in August 2023, a Montana judge ruled in favor of 16 youth plaintiffs who had accused state officials of violating their constitutional rights by promoting fossil fuels. The state's supreme court affirmed the judge's findings in late 2024. But state lawmakers have since violated her ruling, enshrining new laws this year that contradict it, argue 13 of the 16 plaintiffs in a petition filed on Wednesday...

Immigration judges fired in July after Congress sent money to hire more : NPR

"It's outrageous and against the public interest that at a time when the Congress has authorized 800 immigration judges, we are firing large numbers of immigration judges without cause," said Matt Biggs, president of the IFPTE union. "This is hypocritical — you can't enforce immigration laws when you fire the enforcers."…

Trump orders the government to stop enforcing rules he doesn’t like - The Washington Post

"The conscious effort to slow down enforcement on such a broad scale is something we have never seen in previous administrations," said Donald Kettl, a professor emeritus at the University of Maryland's School of Public Policy. "It amounts to a dramatic assertion of presidential power and authority."…

‘Partisan politics’: how efforts to overturn the Johnson amendment could upend campaign finance

"I think it'll have as big, or a bigger impact than Citizens United," said Andrew Seidel, a constitutional attorney and expert on Christian nationalism. "I don't think people are fully prepared for a country in which churches can accept tax deductible donations in the billions of dollars and then turn around and use that money for partisan politics."…

In the short run, overhauling the provision could, Seidel said, allow churches to function effectively as Super Pacs, accepting tax-deductible donations from politically-motivated donors and channeling them into political causes. Such a scenario could, Seidel cautions, force churches to subject themselves to the same financial disclosures that Super Pacs face.

The church could be the subject of litigation, but then again, who's going to be running the IRS? Who's going to be enforcing that?" said Seidel. "It'll be the Trump administration."

Why Can’t We Stop Unauthorized Immigration? Because It Works. - The New York Times

Congress tends to invest heavily in immigration enforcement but not in the enforcement of labor laws that could dissuade businesses from exploiting unauthorized workers in the first place.

IRS is using $60B funding boost to ramp up use of technology to collect taxes − not just hiring more enforcement agents

The IRS plans to use most of these new funds to step up enforcement and improve customer service for taxpayers.

There's been plenty of conjecture about what the added enforcement will look like and no shortage of fearmongeringabout the tens of thousands of new agents the IRS might hire.

Often left out of this discussion is the fact that the agency's staffing was cut by 22% between 2010 and 2021. Much of the agency's hiring spree will replace these labor shortages rather than fill new posts. Further, the IRS expects over 50,000 of its employees to retire within five years.

The agency aims to hire 20,000 people over the next two years, of which one-third will work in enforcement…
