Remembering a White supremacist coup (The Reveal podcast)

On the eve of a contentious election, Reveal looks back to the nearly forgotten election of 1898 in Wilmington, North Carolina, where a coup d’etat gave birth to much of the structural racism that exists today. 

First, we learn that in the late 19th century, Wilmington was a city where African Americans thrived economically and held elected office. This, however, did not sit well with White supremacists, who plotted to retake control of the city.

The story continues with accounts of violence against Black voters on Election Day 1898 and the subsequent overthrow of the local government. We then explore how the Wilmington coup provided a blueprint for the Jim Crow South and continues to influence issues of race to this day.

We end with a story from Reveal’s Will Carless about an organization called the Public Interest Legal Foundation, which for almost a decade has perpetuated false claims of widespread voter fraud in U.S. elections.

Who Are The Armed Civilians Showing Up At Protests? (The 1A)

The presence of militia groups, supposedly there to protect property, had been making protesters and residents in Kenosha, Wisconsin uncomfortable. But then, 17-year-old Kyle Rittenhouse opened fire with a gun he was not legally allowed to own and killed two protesters.

Rittenhouse is far from the only armed civilian to show up at police brutality and antiracist protests. This year, white supremacists and far-right actors have done so at least 497 times. In Kenosha, police were filmed arresting members of Riot Kitchen, a Seattle-based organization dedicated to feeding demonstrators, while leaving members of armed militia groups alone.

Police often deny links to extrajudicial groups. But a recent report from the Brennan Center for Justice highlights links of varying severity between police, white supremacists and militias. These ties have been discovered in Alabama, California, Connecticut, Florida, Illinois, Louisiana, Michigan, Nebraska, Oklahoma, Oregon, Texas, Virginia, Washington and West Virginia.

What’s the history behind these connections?

And more broadly, what makes something a militia? Who are in these groups? And what legal standing do they have?

Birthers are Back and Roberts’ Stealth Attack on Abortion Rights (Opening Arguments podcast OA413)

This is not a happy episode, really, unless you enjoy Andrew completely demolishing racist birtherism crap published in Newsweek about Kamala Harris. The author is the same racist asshole who, curiously enough, wrote this: Ted Cruz’s Citizenship Makes Him Eligible to be President. Ted Cruz wasn’t born in this country, but Kamala Harris was. I wonder what the difference is? Here to help debunk this racist crap is the 14th Amendment. Also Garrett Epps, The Citizenship Clause: A “Legislative History”; U.S. v. Wong Kim Ark, 169 U.S. 649 (1898); Hamdi v. Rumsfeld, 542 U.S. 507 (2004).

The first segment is some things Andrew was wrong about.. and the main segment is a depressing deep dive on how John Roberts has successfully undermined reproductive rights with almost no one noticing. Dahlia Lithwick noticed though and wrote John Roberts’ stealth attack on abortion rights in June Medical v. Russo just paid off. Andrew dives deeper into this and explains what happened in June Medical Services LLC v. Russo and how the 8th Circuit has capitalized on this.

Chilliwack Provincial Court Judge Kristen Mundstock made it clear she didn't want to limit the religious freedom of the father, who is known in court documents as JKH. But she said she feared his three young children — who live with their mother, AJH — would become social outcasts if they adopted their father's extreme views. ...
