Five claims the president made in primetime address not backed up by evidence

…The Department of Homeland Security did not reveal its methodology for identifying the noncitizens and how confident they were in their assessment. The tool the Department of Homeland Security uses to flag noncitizens on the voter rolls is known to be inaccurate. 

Letters from the Department of Homeland Security sent on Thursday to Nevada and Pennsylvania obtained by the Guardian also suggest that the government is much less certain that the people identified are actually noncitizens. The Nevada letter says the department identified as many as 15,903 noncitizens who were registered to vote, including 8,576 whose name, date of birth, address and social security number matched that of a noncitizen in its files. It did not say how it flagged the remaining potential noncitizens. .

“These numbers are wildly speculative at best and the Department of Homeland Security hasn’t shared anything that backs it up,” Cisco Aguilar, the Democratic Nevada secretary of state, said in a statement…

Appeals court rules against ICE’s mandatory detention policy - POLITICO

In a 3-0 ruling, a panel of the New York-based 2nd Circuit Court of Appeals found that ICE’s policy was based on a flawed, implausible and unprecedented interpretation of decades-old laws. But more fundamentally, the panel said the Trump administration’s position would raise acute constitutional concerns by instituting “the broadest mass detention-without-bond mandate in our Nation’s history for millions of noncitizens.”…

Widespread Errors: An expanded federal tool for identifying noncitizens on voter rolls is making persistent mistakes, particularly in assessing citizenship for people born outside the U.S. 

 Banned From Voting: In Missouri, state officials told local clerks to temporarily ban flagged voters from casting ballots, even though hundreds turned out to be citizens. 

Texas Confusion: As errors emerged in SAVE data, local clerks said the state hadn't provided them with clear guidance and worried about disenfranchising eligible citizens...

Trump says he will ‘permanently pause’ migration from ‘third world countries’ after national guard shooting

In a social media post beginning with "a very happy Thanksgiving," sent after 11pm on Thursday, the US president said his administration would "end all federal benefits and subsidies to noncitizens" and remove "anyone who is not a net asset to the United States". 

It as not clear how the president would enact such a "pause" in migration. Previous bans issued by his administration have faced challenges in the courts and in Congress...

Trump echoes racist conspiracy theory about noncitizens voting : NPR

Democratic opponents of these measures say the current system is already working to deter noncitizens from voting, as evidenced by the very small number of documented cases. 

They also say the proposed federal legislation would make it harder for some eligible U.S. citizens to vote, especially voters of color, who are more likely to lack access to a document proving their citizenship, like a birth certificate or passport. 

The decision by Republicans to fixate on this bill on the eve of the election — when it is already too late to change protocols for this contest — indicates the goal is to provide "oxygen for lies in the post-election period if Trump loses," said David Becker, the executive director of the Center for Election Innovation and Research. 

"You can absolutely bet if Trump loses, he will claim there was widespread noncitizen voting without any evidence whatsoever," Becker said. "And that is going to incite anger and potentially violence."…

Noncitizens cannot vote in federal elections, states have safeguards in place to ensure only eligible voters cast ballots and there is little evidence noncitizens are voting.

Trump and Johnson spread unfounded fears by urging non-citizen voting ban

The idea that non-citizens are voting in US elections in large numbers is a lie. Several studies have shown that the number of non-citizens who successfully vote is extremely small. For example, a 2017 analysis by the Brennan Center for Justice of 42 jurisdictions in the US found that non-citizens were 0.0001% of the votes cast.
