US edges closer to popular vote deciding winner of presidential elections

Under the National Popular Vote Interstate Compact, states would assign their presidential electors to the winner of the popular vote, regardless of the results within the state. The compact takes effect when states representing a majority of electoral votes – 270 of 538 – pass the legislation and thus would determine the winner of the presidential contest. With Virginia, the compact now has 222 electors...

Two men have re-engineered the US electoral system in favor of Republicans

"…Jankowski pioneered Redmap, short for the Redistricting Majority Project. That 2010 strategy, coordinated when he worked at the Republican State Leadership Committee (RSLC), flipped state legislative chambers in Ohio, Michigan, Pennsylvania, Alabama, North Carolina, Wisconsin, Indiana, Tennessee and several other states just ahead of the decennial redistricting. Then, with complete control of those processes, as well in Florida, Georgia, Texas and elsewhere, the RSLC helped draw some of the most extreme partisan gerrymanders in history, locking in huge Republican advantages in state legislatures and congressional delegations…"

How Minority Rule Threatens Democracy (Terry Gross; Fresh Air podcast)

It's a fundamental tension in a democracy: How do you have majority rule in a way that also protects minority rights? Journalist Ari Berman says the Founding Fathers struggled with that question back in 1787 — except, for them, white male landowners were the minority in need of protection.

"Most of the founders were skeptical of the public's ability to elect the president directly," Berman says. "So they created this very complicated situation in which electors would elect the president instead of the people electing the president directly."

In his new book, Minority Rule, Berman connects the debates and compromises of the country's founders to contemporary politics. He says the founding fathers created a system that concentrated power in the hands of the elite and that today, institutions like the Electoral College and the Senate — designed as a check against the power of the majority — are having much the same effect.

Voter Concerns Over Abortion Are Shattering Trump's Electoral College Edge

So while many national polls are showing the 2024 race virtually tied between Biden and Trump — should the two men win their respective party nominations — Democrats have made headway in cutting into any GOP advantages in Michigan, Pennsylvania, and Wisconsin. All three states were won by Trump in 2016 but flipped to Biden in 2020, and they are essential to the president's calculus for winning reelection next year. 

Trump's 2016 wins in Michigan, Pennsylvania, and Wisconsin were fueled by strong support among white-working class voters, many of whom had defected from previously backing Democratic presidential candidates. But with Democrats not collapsing with white voters in those states either last year or in recent statewide polling, Trump's Electoral College edge may either be severely curtailed or obliterated by the time the 2024 election rolls around...

…Republicans are promoting an "independent state legislature" doctrine, which holds that statehouses have "plenary," or exclusive, control of the rules for choosing presidential electors. Taken to its logical conclusion, it could provide a legal basis for any state legislature to throw out an election result it dislikes and appoint its preferred electors instead.

The question could arise, and Barrett's vote could become decisive, if Trump again asks a Republican-controlled legislature to set aside a Democratic victory at the polls. Any such legislature would be able to point to multiple actions during the election that it had not specifically authorized. To repeat, that is the norm for how elections are carried out today. Discretionary procedures are baked into the cake. A Supreme Court friendly to the doctrine of independent state legislatures would have a range of remedies available to it; the justices might, for instance, simply disqualify the portion of the votes that were cast through "unauthorized" procedures. But one of those remedies would be the nuclear option: throwing out the vote altogether and allowing the state legislature to appoint electors of its choosing…
