How abortion in America has changed since the Dobbs decision : NPR

…But other developments have been surprising, including the role of the internet and the mail in increasing access to abortion, even in those very same states. This year, voters will again consider ballot measures to protect or restrict abortion access across the country. Abortions in the US are on the rise three years after Roe v Wade was overturned

"There's more abortion taking place in Mississippi today than there was prior to Dobbs," said Dr Angel Foster, a co-founder of the Massachusetts Medication Abortion Access Project (Map), which uses shield laws to ship abortion pills out to about 2,500 patients a month. "That really speaks to how little access some folks had to in-clinic abortion care prior to Dobbs and how shield law provision and telemedicine has really stepped into that space."…

Senate Democrats to spotlight threats to abortion access on Dobbs anniversary - The Washington Post

In a forum designed to resemble a congressional hearing at the Capitol, Davis will share her story with an audience of Senate Democrats and members of the press alongside other witnesses, including two abortion providers. They will speak about their experiences in the three years since the high court eliminated the nearly 50-year constitutional right to an abortion — part of an ongoing effort from some Democrats to keep steadfast attention on the issue. The event, known as a shadow hearing, allows for a public forum to be held without conducting an official Senate hearing, which would've required approval from Republican leaders who chair committees...

New report warns of rise in pregnancy criminalization in Post-Roe America

In fact, most prosecutions documented in the report did not actually involve abortion: Of the 200 cases, only one was prosecuted under a law specifically meant to criminalize abortion. The others involved statutes related to child abuse, neglect or endangerment, which treat an embryo or fetus as a person with legal rights that compete with those of the pregnant person. The report notes that prosecutors often don't need to prove that any actual harm occurred to the fetus, they merely have to demonstrate that a pregnant woman posed some "risk" to her pregnancy. 

That includes the case of Amari Marsh, a 23-year-old South Carolina woman who miscarried in June 2023. After miscarrying, she was arrested and charged with "murder/homicide by child abuse." Marsh spent 22 days in jail before being placed under house arrest. She faced 20 years in prison. It was more than a year later that she was finally cleared by a grand jury and told that her case would not proceed to trial. 

And that is what happens when you criminalize abortion: You criminalize pregnant women. When the state has a controlling stake in every pregnant woman's body, every miscarriage is a potential prosecution. …

Support rising for access to abortions for any reason: Survey

A solid majority of respondents — 61 percent — in the June survey say that their state should allow someone to obtain a legal abortion if "the person does not want to be pregnant for any reason." 

That represents a 12 point increase from the 49 percent who held that view in a June 2021 survey, which was conducted one year before the Supreme Court overturned the federal right to an abortion in Dobbs v. Jackson Women's Health Organization… 

The rise in such support extends across the political spectrum and gender divide…

Georgia six-week abortion ban: Judge blocks the law, criticizing Alito.

Certainly, McBurney did not attempt to conceal his own contempt for Dobbs. The pointed quotation marks ("historical 'facts' ") gesture toward the majority's butchering of history. The sardonic quips indicate displeasure with Justice Samuel Alito's strident and angry assault on women's equality. But this rhetoric should not distract from McBurney's fundamentally sound conclusion. Georgia wants the courts to adopt the legal fiction that Roe and Casey were never really law. Under Georgia Supreme Court precedent, courts cannot oblige. The LIFE Act was "void at birth," so it cannot "somehow spring to life because of a change in constitutional exegesis coming from a higher court."… 
 In that sense, the void ab initio doctrine is a tool of accountability. Lawmakers cannot evade responsibility for their votes by enacting an unconstitutional law on the hunch that, at some point in the future, five justices will change the meaning of the Constitution. McBurney's ruling is not "judicial supremacy run amok," as Georgia lawyers complained. It is a straightforward requirement that the legislature's acts comply with the Constitution that exists at that moment rather than the Constitution it hopes will exist in the future…
