Court deals first blow to Trump’s coal rescue campaign - POLITICO

“DOE needs to stay in its lane and use its emergency powers only in actual emergencies,” Lenoff said in a statement following the ruling.

“Preventing the market-driven retirements of coal plants to advance a coal-friendly agenda is not a proper use of emergency powers,” he said. “We will continue to challenge unlawful orders if DOE persists in issuing them.”…

The child safety trial against Meta kicks off in federal court : NPR

"Meta's business model can be summed up in four simple words: 'hook' the users, 'hold' them for as long as they can, 'harvest' their data, and then 'hide' the truth from the public when making public statements," California Deputy Attorney General Megan O'Neill said in her opening statement.

"It was especially bad for kids," she said…

US federal court blocks Trump from imposing sweeping tariffs | Trump tariffs | The Guardian

The other was filed by a dozen US states, led by Oregon. "This ruling reaffirms that our laws matter, and that trade decisions can't be made on the president's whim," said the Oregon attorney general, Dan Rayfield.

The plaintiffs in the tariff lawsuit argued that the emergency powers law did not give the president the power to apply tariffs, and even if it had done, the trade deficit did not qualify as an emergency, which is defined as an "unusual and extraordinary threat". The US has run a trade deficit with the rest of the world for 49 consecutive years...

Republicans in Congress want to pass law to help Trump’s criminal defense

"Conservatives want a floor vote on a bill that would allow current or former presidents to move any state case brought against them — such as the one in New York that resulted in Trump's conviction — to federal court, according to multiple House Republican sources."

Court rejects parents’ attempt to opt kids out of LGBTQ-inclusive reading assignments | The Hill

In August 2023, U.S. District Judge Deborah Boardman found that the parents were unlikely to succeed on the merits and denied their request to keep the policy in place while the case proceeds. She found that they failed to show that the lack of an opt-out policy would result in the "indoctrination of their children" or "coerce their children to violate or change their religious beliefs."

"The parents still may instruct their children on their religious beliefs regarding sexuality, marriage, and gender, and each family may place contrary views in its religious context," Boardman wrote in the order last year.

"No government action prevents the parents from freely discussing the topics raised in the storybooks with their children or teaching their children as they wish," she added...

How lawyers from Jones Day influenced Trump's Supreme Court picks : NPR

Jones Day was the law firm that basically ended the eviction moratorium during the pandemic that the Biden administration had imposed. And Jones Day, just reading the tea leaves and talking to their lawyers now, it's quite clear that they are plotting a wide range of attacks on the power of the federal government to oversee private businesses and private companies in a way that goes back to Don McGahn and his colleagues' hatred of the so-called administrative state. And they are now in a position to be able to much more forcefully advocate those positions and be successful in their advocacy — thanks to all of the judges that Trump, at McGahn's direction and with McConnell's support, managed to get on to virtually every federal court in the country…

Opinion | The federal court ruling blocking Texas’s abortion law is a marvel - The Washington Post

… Wow. What just happened here? First, Pitman's ruling makes a mockery of the Supreme Court's thin argument that the law was so "complex" that the court couldn't possibly agree to issue an injunction on an emergency basis. There is nothing complex — or constitutional — about Texas's scheme to set up bounties for those who seek abortions.
Second, Pitman lays bare the deceitful crafting of a bill that seeks to rob people of their constitutional rights. And unlike the Supreme Court, he is not willing to play along with a ruse that would emasculate federal courts. Apparently, he has more institutional reverence for the federal judiciary than do the right-wing Supreme Court justices who allowed state lawmakers to skirt around the courts...
