Years after the Cambridge Analytica scandal, New Mexico takes Facebook to trial

Attorney Randi McGinn, representing New Mexico, told jurors that Cambridge Analytica had used Facebook profile data to target Democratic voters with messaging such as “Hillary’s got it, you don’t need to vote” in an alleged attempt to reduce voter turnout.

Cambridge Analytica’s clients included the 2016 campaign for Donald Trump. Cambridge Analytica closed in 2018 as a result of the scandal…

‘Team Jorge’ and Cambridge Analytica meddled in Nigeria election, emails reveal

Four weeks before a pivotal presidential election in Nigeria, an Israeli private operative specialising in political "black ops" was preparing his trip to the country. On 17 January 2015 the man, who used the alias "Jorge", emailed Cambridge Analytica, the political consultancy he was coordinating with on a covert plan to manipulate Africa's largest democracy...

Trump's super PAC used fear to win votes, says Cambridge Analytica whistleblower Brittany Kaiser

What began as a super PAC intended for Senator Ted Cruz eventually devolved into Defeat Crooked Hillary, a super PAC for then-presidential candidate Donald Trump that was more formally known as Make America Number 1. After his election, the super PAC and the Trump campaign met with Cambridge Analytica staff for a two-day debrief on their strategies and tactics for winning the election. “Unfortunately, what they found out was the only very successful tactic was sending fear-based, scaremongering messaging to people that were identified as being neurotic,” says Cambridge Analytica whistleblower Brittany Kaiser. “It was so successful in their first experiments that they spent the rest of the money from the super PAC over the rest of the campaign only on negative messaging and fear-mongering.” No recent progress has been made in terms of regulating data usage despite multiple congressional hearings regarding Facebook’s role in misinforming and manipulating voters. This should raise great concern amongst Americans as the primaries begin, says "The Great Hack" filmmakers Jehane Noujaim and Karim Amer. “Our elections are for sale. … Democracy has been broken," says filmmaker Jehane Noujaim. “No election laws have changed. Facebook’s a crime scene.”....

The Weaponization of Data: Cambridge Analytica, Information Warfare & th...

We continue our conversation with the directors of “The Great Hack,” Jehane Noujaim and Karim Amer, as well as former Cambridge Analytica employee Brittany Kaiser and propaganda researcher Emma Briant, about Cambridge Analytica’s parent company SCL Group’s history as a defense contractor. “We’re in a state of global information warfare now,” Briant says. “How do we know if our militaries develop technologies and the data that it has gathered on people, for instance, across the Middle East … how do we know when that is turning up in Yemen or when that is being utilized by an authoritarian regime against the human rights of its people or against us? How do we know that it’s not being manipulated by Russia, by Iran, by anybody who’s an enemy, by Saudi Arabia, for example, who SCL were also working with? We have no way of knowing, unless we open up this industry and hold these people properly accountable for what they’re doing.” ....

“The Great Hack”: Big Data Firms Helped Sway the 2016 Election. Could It Happen again in 2020?

The documentary “The Great Hack,” which was shortlisted from the Oscars, explores how the data firm Cambridge Analytica came to symbolize the dark side of social media in the wake of the 2016 U.S. presidential election. Cambridge Analytica collapsed in May 2018 after The Observer newspaper revealed the company had harvested some 87 million Facebook profiles without the users’ knowledge or consent. Cambridge Analytica then used the data to sway voters to support President Trump during the 2016 campaign. We speak with “The Great Hack” co-directors Karim Amer and Jehane Noujaim, as well as Cambridge Analytica whistleblower Brittany Kaiser.....

Propaganda Machine: The Military Roots of Cambridge Analytica’s Psychological Manipulation of Voters

We continue our discussion of data harvesting, targeted advertising and voter manipulation — practices used by firms like Cambridge Analytica. The secretive data firm collapsed in May 2018 after The Observer newspaper revealed the company had harvested some 87 million Facebook profiles without the users’ knowledge or consent to sway voters to support Trump during the 2016 campaign. A new trove of internal Cambridge Analytica documents and emails are being posted on Twitter detailing the company’s operations, including its work with President Trump’s former national security adviser John Bolton....

Fake news grabs our attention, produces false memories and appeals to our emotions

“Fake news” is a relatively new term, yet it’s now seen as one of the greatest threats to democracy and free debate. In the Netflix documentary The Great Hack — which chronicled the rise and fall of Cambridge Analytica — we saw how Facebook data was used to target potential voters with insidious right-wing propaganda packaged as if it were news.

Katy Perry & Facebook (Opening Arguments podcast OA303)

Today’s episode checks in on the record-setting $5 billion settlement that Facebook reached with the Federal Trade Commission for, among other things, violating a prior consent order by enabling developers like Cambridge Analytica to access your data without your permission. Is this a good deal for American consumers? It’s complicated. Oh, and you also get more music law with Katy Perry, and so much more!

We begin with an update on the Senate’s last-ditch push to nominate more than a dozen new Trump nominees for lifetime appointments on the federal bench. And yes, despite widespread opposition, despite minimal credentials in many cases, and despite all of them having disqualifying right-wing ideologies… all were confirmed before the Senate decided to take a break. (Sorry for the bad news.)

Then, it’s time for the deep dive into the Facebook-FTC settlement, which does indeed impose the single largest penalty ever for a consumer protection violation. Learn why the Democratic minority at the FTC thought it wasn’t enough, and along the way you’ll learn a lot about the FTC.

After that, it’s time to revisit music law, this time with a jury verdict that Katy Perry violated the copyright of Christian rapper Flame. Andrew gives you the law, and Thomas gives you the music — you won’t want to miss this segment!

Then — as if that wasn’t enough — it’s time for the answer to a brand-new #T3BE involving beer, the Constitution, and the notions of justiciability and ripeness. It’s not quite as good as having a beer, but it’s still a good segment!

Cambridge Analytica (Opening Arguments podcast #158)

In this rapid-response episode, Thomas and Andrew discuss the scandal regarding Cambridge Analytica. Is there a legal angle? Have crimes been committed? Listen and find out!

In the pre-show segment, Andrew helps out our reporters by giving theme the question they need to be asking regarding Stormy Daniels, which is: “Now that you’ve acknowledged that you’re DD, and you’ve sued Stormy Daniels for $20 million, can you tell us what claims you had against Ms. Daniels that you believe you settled in that agreement? What could you have sued her for?” You’re welcome.

That segues into the “A” segment, where the guys discuss the differences (and one strange overlap) between the recent lawsuit filed by Karen McDougal and the top-of-Yodel-Mountain Stormy Daniels lawsuit.

After the main segment, we tackle a listener question regarding the difference between textualism and originalism, inspired by our most recent episode, Episode 157.

Finally, we end with an all-new TTTBE #68 that requires some math to figure out the appropriate measure of damages for breach of contract. Remember that you can play along with #TTTBE by retweeting our episode on Twitter or sharing it on Facebook along with your guess. We’ll release the answer on next Tuesday’s episode along with our favorite entry!
